Personal data protection terms and conditions

This privacy policy is designed to protect the privacy of past, present and future customers of Borealis Lithuania (“Borealis”). Accordingly, we set out the principles that govern the collection, use, disclosure, transfer and storage of Customer Data. Borealis’ activities comply with European Union legislation and the laws of the Republic of Lithuania. Your privacy and the security of your personal data are of paramount importance to us.

1. Definitions

1.1. Client – a natural person who wishes to purchase goods, who has purchased goods or who uses the warranty and repair services offered.
1.2. Customer personal data – Customer Personal Data means any data relating to an identified or identifiable natural person, regardless of the form or format in which such data is stored. Personal data includes, for example, customer data such as name, gender, age, personal identification number, email address, residential address, telephone number, bank details, income, photographs and video recordings.
1.3. Processing of personal data – any operation performed on personal data, including collection, recording, storage, alteration, etc.
1.4. Data Controller – The Data Controller is Borealis Lithuania, a limited liability company established and operating in accordance with the laws of the Republic of Lithuania, company registration number 306160961, registration address Krivių g. 5, LT-01204 Vilnius, Republic of Lithuania, e-mail address info@borealis.lt and telephone number +370 629 38095.
1.5. Authorised processor – a natural or legal person, public authority, agency or other body which processes personal data on behalf of the processor.

2. Processing principles

“Borealis pays particular attention to the confidentiality and protection of the Client’s personal data and ensures the lawfulness of the processing of the Client’s personal data.

2.1. For the customer, the processing is lawful, fair and transparent;
2.2. Personal data shall be collected for specified, explicit and legitimate purposes and shall not be further processed in a manner incompatible with those purposes;
2.3. Personal data are adequate, relevant and only necessary for the purposes for which they are processed;
2.4. Personal data shall be accurate and, where necessary, kept up-to-date and all reasonable steps shall be taken to ensure that personal data which are inaccurate in relation to the purposes for which they are processed are erased or rectified without delay;
2.5. The personal data will be stored in a form which permits identification of the Customer for no longer than is necessary for the purposes for which the personal data are processed;
2.6. Personal data shall be processed in such a way as to ensure appropriate security of personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.

3. Processing objectives

“Borealis processes the Customer’s personal data for the purposes of performance of a contract, legitimate interest or to comply with a legal obligation. “Borealis shall process personal data voluntarily provided by the Customer when the Customer consents.

Personal data may include: name and surname, telephone number, date of birth, personal identification number, address (street / village, house number, apartment number, city or town, county, postcode), email address, method of delivery, method of payment used to pay for the goods, and the goods and services purchased and the value of those goods and services.

“Borealis processes the Client’s personal data:

3.1 The following data shall be processed for the purposes of concluding and executing a purchase and sale agreement with the Customer at the points of sale and in the online shop, as well as for the purposes of issuing invoices and sending them to the Customer:
Customer’s name and surname, telephone number, email address, payment method used, goods and services purchased and their value, delivery method;
3.2. To apply for a consumer credit. Borealis processes the personal data provided by the Customer for the purpose of transmitting the Customer’s application for consumer instalment credit to the creditor. For the purpose of concluding an instalment credit agreement and to the extent necessary to ensure the rights and obligations related to the performance of the instalment credit agreement, in addition to the personal data referred to in clause 3.1, we will also transmit the following personal data of the Customer to the creditor:
Client’s personal identification number, document number, number of dependants, marital status, level of education, occupation, job title, date of employment, income level, source of income, information on loan and lease liabilities (including name of the loan or landlord, balance, monthly instalment), type of housing, down payment amount, eligible repayment date, eligible contract duration, approximate monthly payment, consent to be consulted in the Pension Savings Fund Register, information on the performance of essential public functions by the applicant for consumer credit/premium, his/her family member or close relative.
3.3. regarding the shipping and delivery of the Goods purchased from Borealis:
If the Customer chooses a post office, parcel shop or courier service as the method of delivery of the Goods, Borealis has the right to transfer the Customer’s personal data to the relevant service provider to the extent necessary for the delivery of the Goods to the Customer;
3.4. The data referred to in Clause 3.1 shall be processed for the purpose of sending the Customer notifications relating to the performance of a contract of sale concluded or to be concluded by the Customer or relating to requests made by the Customer for information on prices or products, as well as for the purpose of correspondence with the Customer;
3.5. For the purpose of servicing the Customer for the maintenance of the Customer’s equipment in accordance with the warranty and repair procedures, the data referred to in clause 3.1 shall be processed;
3.6. For the purpose of issuing certificates relating to the insurance of the Goods or the extension of the warranty period, the data referred to in section 3.1 will be processed at Borealis dealerships;
3.7. “Borealis is a processor of personal data which may transfer the necessary personal data to a financial institution for the purpose of making a payment.

Storage principles

“Borealis will retain personal data for as long as they are necessary for the purposes for which they are processed, but no longer than the expiry of the statutory limitation periods.

4. Data retention periods

4.1. If Borealis wishes to keep the personal data longer than necessary for the purpose for which it was collected, Borealis will depersonalize the personal data so that the Customer’s identity can no longer be established.

5. Client rights

5.1 Right of access to your data.
5.2 Right to rectification.
5.3 Right to restriction of processing.
5.4 Right to data portability.
5.5 Right to erasure.
5.6 Right of objection.

“Borealis will respond to the Client’s requests promptly, but at the latest within one month of receipt of the Client’s request. If necessary, this period may be extended by two months, depending on the complexity and volume of the request. Borealis shall inform the Client of any such extension and the reasons for the delay within one month of receipt of the request. If the Client submits the request electronically, the information shall, where possible, also be provided electronically, unless the Client requests otherwise. In addition, the Customer shall have the right to bring an action before the Data Protection Inspectorate or a court at any time if his/her rights are violated.

6. Security

“Borealis takes all precautions (including administrative, technical and physical measures) to protect the Customer’s personal data. Access to the processing of the data shall only be granted to authorised persons. If the Client suspects that his/her personal data has been processed in breach of this Privacy Policy and/or there is a risk that the data may be leaked to unauthorised persons, the Client is requested to immediately inform Borealis of such event, if possible.

6.1. In order to ensure a high level of security in the processing of personal data, the Client undertakes to submit all requests concerning his/her personal data, signed with an electronic signature, to Borealis by e-mail info@borealis.lt.
6.2. “Borealis processes the Customer’s personal data in accordance with the legal requirements and only to the extent necessary for the conclusion and performance of sales contracts, for warranty and repair procedures and for the rights and obligations related to the use of the online shop. Borealis may use the Customer’s personal data to protect its rights and may transfer the Customer’s personal data to third parties to the extent necessary to protect its rights.
6.3. “Borealis will not transfer, sell or disclose the collected personal data to third parties without the Customer’s prior consent, except where required to do so by law or as provided for in the terms and conditions of sale.

7. Validity and amendments

7.1. Customers can access the terms and conditions for the protection of personal data on the Borealis website and in the sales offices.
7.2. “Borealis reserves the right to unilaterally update, revise and supplement the Personal Data Protection Terms and Conditions at any time, in accordance with applicable law, by informing the Client of the changes on the Borealis website and/or by email.
